These Terms of Service ("Terms") govern your use of the Terpa mobile application ("the App"), operated by Atlas Elevated ("we," "our," or "us"). Please read these Terms carefully before using Terpa.

1. Acceptance of Terms

By downloading, installing, or using Terpa, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and Atlas Elevated.

2. Eligibility

You must be of legal age to use cannabis in your jurisdiction (19+ in Canada, 21+ in the United States) to use Terpa. By using the App, you represent and warrant that you meet this age requirement and that cannabis use is legal in your jurisdiction. We reserve the right to terminate accounts if we have reason to believe a user does not meet eligibility requirements.

3. Description of Service

Terpa is a personal cannabis journal and terpene education platform. The App provides:

• A personal journal for tracking cannabis consumption experiences, including strains, methods, moods, ratings, and costs.
• Educational content about terpenes, their effects, and their presence in various cannabis strains.
• Personalized strain recommendations based on your preferences and journal history.

Terpa is NOT a medical service, healthcare provider, or cannabis retailer. We do not sell, distribute, or facilitate the purchase of cannabis or cannabis products. We do not provide medical advice, diagnoses, or treatment recommendations.

4. User Accounts

To use Terpa, you must create an account. You agree to:

• Maintain only one account per person.
• Provide accurate information during registration.
• Keep your login credentials secure and confidential.
• Notify us immediately of any unauthorized access to your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or in bad faith.

5. Subscriptions & Billing

Terpa offers a free tier with limited features and a Pro subscription with full access to all features. Pro subscriptions are billed through the Apple App Store. By subscribing, you acknowledge and agree to the following:

• Subscriptions auto-renew at the end of each billing period (monthly or annual) unless cancelled.
• To cancel your subscription, go to your device's Settings > Apple ID > Subscriptions and cancel from there. Cancellation within the App is not supported.
• Pricing is as displayed at the time of purchase and may vary by region.
• Refunds are handled exclusively by Apple in accordance with Apple's refund policy. Atlas Elevated does not process refunds directly.
• If you cancel, you retain access to Pro features until the end of your current billing period.

6. Disclaimer

Terpa provides educational information about terpenes and cannabis strains based on publicly available research and user-reported experiences. This information is NOT medical advice. Terpa does not diagnose, treat, cure, or prevent any disease or condition. Always consult a healthcare professional before making decisions about cannabis use.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

7. Cannabis Legal Compliance

You are solely responsible for ensuring your cannabis use complies with all applicable laws, regulations, and ordinances in your jurisdiction. Terpa operates only in jurisdictions where cannabis is legal for adult use. The availability of the App does not constitute an endorsement of cannabis use where it may be prohibited. We make no representations regarding the legality of cannabis use in any specific jurisdiction.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Atlas Elevated and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the App.

In no event shall our total liability to you for all claims arising from or relating to the App exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim. You acknowledge that the information provided in the App is for educational and personal journaling purposes only, and you assume all risk associated with your reliance on any such information.

9. Intellectual Property

All content, design, graphics, trademarks, logos, source code, and other intellectual property displayed in or associated with Terpa are the exclusive property of Atlas Elevated or its licensors. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without prior written consent from Atlas Elevated. Your use of the App does not grant you any ownership rights in the App or its content.

10. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time by contacting support@terpa.app. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
